Copyright Artistic Works

When you create something visually unique, the law automatically gives you rights over that creation. However, securing a formal copyright registrationprovides the strongest legal proof that you are the original artist or owner. At M&P IP Protectors, we help creators, graphic designers, and businesses protect their visual assets from being copied or misused by others.
What Counts as an Artistic Work?
Under the Copyright Act, 1957, an "artistic work" covers a wide variety of visual creations. It does not matter if the artwork is considered a masterpiece or just a simple sketch; as long as it is original and created by you, it can be protected.
Common examples include:
- Brand Logos: The unique symbol, graphic, or mascot used to represent a business.
- Photographs: Original pictures taken by a photographer, whether for commercial use or art.
- Drawings and Paintings: Sketches, digital illustrations, canvas artwork, and graphic designs.
- Architectural Plans: Blueprints, building designs, and floor plans created by an architect.
- Craftsmanship: Artistic features applied to physical objects, such as unique jewellery patterns or decorative furniture elements.
The Special Rule for Brand Logos
If you want to register a logo that you plan to use for your business, there is a special extra step. Before the Copyright Office will accept your logo application, you must first get a clearance certificate from the Trademark Office. This certificate proves that your artwork does not copy or look too much like someone else's registered brand.
(Note: If your creation is mostly text-based, like a book, website article, or computer code, it must be protected as a copyright literary workinstead.)
Why Protect Your Visual Creations?
Registering your artistic work is the best way to stop competitors from using your pictures on their websites, printing your graphic designs on their merchandise, or copying your building plans. If someone does steal your work, having a government-issued registration certificate allows you to take strict legal action to stop them and ask for financial compensation.
The Registration Process
The process involves filing exact copies of your artwork with the government. Sometimes, the government examiner might have questions about your application or the required clearance certificates. If they send an official letter asking for more details, we manage the situation by drafting a response to copyright objections. We provide the right legal answers to clear up any confusion so your certificate gets approved.
Once your artwork is fully registered, you have the legal right to sell it or even rent it out to other companies through copyright licensing to earn ongoing royalty payments.
To establish clear legal ownership over a logo, photograph, or graphic design, the creative rights team at M&P IP Protectors is available to guide you through the required government paperwork.
