Handling Design Office Actions and Examination Reports

When you submit your application for design registration, the Indian Patent Office does a detailed review. If the examiner finds any mistakes or rule violations, they will issue an official letter called an Examination Report or an "Office Action."
Receiving this letter is a very normal part of the process. It does not mean your design is permanently rejected. It simply means the government needs more information, corrections, or legal explanations before it can officially approve your design rights.
Common Reasons for Objections
The examiner checks your application to make sure it strictly follows the Designs Act 2000. Common reasons for receiving an objection include:
- Lack of Novelty: The examiner believes your design looks too similar to an older product that is already in the public domain.
- Drawing Mistakes: The photos or technical drawings are blurry, do not show all necessary angles, or include extra text and measurements that are not allowed.
- Wrong Category: The product was placed in the wrong Locarno class (the official category system for products) during the filing process.
- Functional Shapes: The shape of the product is strictly based on how it works, rather than how it looks. (As a rule, functional shapes need a patent, not a design registration.)
Strict Government Deadlines
The government sets a firm legal time limit to reply to these objections. In India, you must completely resolve all the examiner's issues within six months from the date the application was filed (with a possible small extension if requested properly).
If you do not file a proper reply before this deadline passes, the Design Office will cancel your application, and you will lose your filing date.
