Design Portfolio Management

Design Portfolio Management

Owning one or multiple registered designs means your business holds a portfolio of intellectual property. Just like taking care of physical real estate, a legal portfolio requires ongoing administrative maintenance.

Design Portfolio Management is the continuous process of tracking your registrations, meeting strict government deadlines, and making sure your visual rights stay active and enforceable over time. If a design registration is not properly maintained, the legal protection simply expires.

The Lifespan of a Design Registration

Once your application successfully completes the design registration phase, the protection does not last forever automatically. Under the Designs Act, 2000, your initial design right is valid for exactly ten (10) years from the date you originally filed it.

To keep your exclusive rights, you must file for a formal renewal before this ten-year period ends. This renewal adds one final five-year extension, giving your design a maximum legal lifespan of fifteen (15) years. If you miss this strict renewal deadline, your design falls into the public domain. When that happens, anyone can legally copy your product's appearance, and you can no longer use design enforcement & litigation to stop them.

Administrative Tracking and Docketing

Missing a government deadline is the most common way businesses accidentally lose their intellectual property. Proper management involves a strict legal calendar system, often called "docketing."

A professional docketing system tracks:

  • Upcoming renewal dates and the exact government fees required.
  • The status of newer applications is still going through office actions & examination support.
  • The strict six-month window for applying in other countries through international design filing.

Our IPR Attorney in Ahmedabad, India, oversees this precise tracking process to ensure that your business never misses a statutory deadline or loses a valuable asset due to an administrative error.

Updating Ownership and Legal Changes

Businesses naturally change over time. If your company changes its official name, moves its headquarters to a new address, or merges with another business, these specific changes must be officially recorded with the Indian Patent Office.

Furthermore, if you decide to rent out your design rights to another manufacturer, those commercial contracts must also be legally recorded on the government register. Keeping these records perfectly updated is a vital part of portfolio management and directly supports your ongoing design licensing & commercialization efforts. At M&P IP Protectors, we maintain the administrative health of your aesthetic assets so your legal ownership is never questioned.
