Under the Designs Act 2000, the fundamental prerequisite for securing aesthetic intellectual property rights is absolute novelty. An industrial design cannot be registered if it has been previously published, disclosed, or registered in India or any other jurisdiction prior to the application date.

To mitigate the risk of statutory rejection, a formal design search is conducted prior to filing. What is commonly referred to in certain foreign jurisdictions as a design patent search serves the same procedural purpose in India: it is a preemptive visual assessment to determine if a proposed article's shape, configuration, or surface pattern already exists in the public domain.

Objectives of a Prior Art Design Search

Unlike a standard patent search that evaluates technical functionality, a design search focuses strictly on visual appearance and aesthetic overlap. Conducting this preliminary assessment is a critical step before proceeding to the formal design registration phase.

The primary legal and procedural objectives include:

  • Verifying Absolute Novelty: Ensuring the design has not been anticipated by any prior publication or existing registration globally.
  • Assessing Distinctiveness: Determining whether the proposed design is significantly distinguishable from known visual combinations in the relevant industry.
  • Preventing Infringement: Ensuring that manufacturing and commercialising the proposed aesthetic article will not infringe upon the active statutory rights of third parties.
  • Avoiding Procedural Rejections: Minimising the likelihood of receiving formal objections from the Design Office regarding prior publication during the substantive examination phase.

Search Methodology and Classification

Industrial designs are categorised under the Locarno Classification, an international system used to classify goods for the purposes of the registration of marks and designs. A comprehensive search relies heavily on identifying the correct Locarno class and subclass for the article in question.

Because novelty is a global standard under Indian law, the search methodology extends beyond domestic registries. The assessment involves:

  • Indian Design Database Review: Scrutinising the official records published by the Indian Patent Office (Design Wing) for active, expired, and pending applications.
  • International Cross-Referencing: Utilising international repositories such as the WIPO design database to identify prior art filed under the Hague System or published by foreign intellectual property offices.
  • Cross-Jurisdictional Analysis: Conducting comprehensive visual reviews through the global design database to ensure the aesthetic features have not been anticipated in major manufacturing hubs or international markets.

Legal Evaluation of Visual Overlap

The existence of similar designs requires precise legal evaluation. The standard for infringement or anticipation in design law is determined by the "eye of the instructed consumer." If two designs are substantially similar in their overall visual impression, the latter design may be deemed devoid of novelty.
