Essential Criteria for Registration

The Indian Patent Office (Design Wing) strictly enforces the statutory thresholds defined in Section 4 of the Designs Act. For a design application to mature into a registered right, it must satisfy the following legal requirements:

  • Absolute Novelty: The design must be new and original. It cannot have been published in India or any other country in a tangible form or by prior use before the date of filing.
  • Industrial Application: The design must be capable of being applied to an article by an industrial process or mechanical means.
  • Aesthetic Appeal: The visual features must appeal to and be judged solely by the eye.
  • Absence of Functional Dictates: If the shape or configuration of an article is dictated solely by the technical function it performs, it is explicitly excluded from design protection and must be evaluated under patent law.
  • Exclusion of Trademarks and Copyrights: A registered design cannot include any trademark, property mark, or artistic work defined under the Copyright Act, 1957.

The Registration Lifecycle

The formal procedure for registering an industrial design requires thorough preparation of representations and adherence to strict statutory timelines.

  • Preparation of Representations: The application must include exact visual representations (drawings, tracings, or high-resolution photographs) of the article from multiple perspectives (e.g., front, back, top, bottom, and isometric views).
  • Locarno Classification: The article must be accurately categorised under the internationally recognised Locarno Classification system, which dictates the specific class of goods to which the design is applied.
  • Formal Filing: The application is submitted using Form 1, accompanied by the requisite representations and statutory government fees.
  • Substantive Examination: The design office examines the filing for procedural compliance and visual novelty. If discrepancies are identified, an official examination report is issued. Resolving these objections requires transitioning into the office actions & examination supportphase.
  • Registration and Term: Upon successfully satisfying all statutory requirements, the design is registered and published in the Official Journal. The initial term of protection is ten (10) years from the date of registration, which can be extended for a single subsequent term of five (5) years.

The precise execution of the application directly dictates the enforceability of the resulting registration. Ambiguous representations or incorrect Locarno classifications can severely limit the scope of the granted rights.
