International Design Filing

When you complete your design registration in India, the legal protection you get is only valid inside Indian borders. If your business plans to export products, manufacture abroad, or sell in global markets, you need to apply for design protection in those specific countries as well.

Because design rights are territorial, someone in another country could legally copy your visual design if you do not have it registered there. Filing internationally ensures that your product's unique shape, appearance, or pattern is protected wherever you do business.

The Six-Month Deadline (Paris Convention)

India is a member of an international treaty called the Paris Convention. This agreement gives Indian businesses a major advantage when filing in other countries, but it comes with a strict time limit.

After you file your first design application in India, you have exactly six (6) months to file the same design in other member countries. If you file within this six-month window, the foreign countries will treat your application as if it were filed on the exact same day as your Indian application. This is called keeping your "priority date."

If you miss this six-month deadline, you lose this priority date advantage. Even worse, your own Indian application might be viewed as public knowledge, which could ruin your chances of getting the design registered abroad.

How to File in Other Countries

Currently, Indian businesses generally protect their designs internationally through the direct filing route.

  • Direct National Filing: This means submitting a separate application to the intellectual property office of each individual country where you want protection (for example, filing directly in the United States or the European Union). Each country will then review the application based on its own local laws.
  • The Hague System: This is a global system managed by the World Intellectual Property Organisation (WIPO) that allows people to apply in multiple countries using one single application. While the Indian government is currently taking steps toward joining this system, Indian companies right now usually have to use the direct filing route, or apply through a foreign branch of their business that is located in a Hague-Convention member country.

Filing in multiple countries means dealing with different languages, different drawing rules, and different local laws. A design drawing that is perfectly fine in India might be rejected in Japan or Europe because of different formatting rules.
